Terms of Service

These Terms govern your use of Stamply, a digital loyalty card service for restaurants, cafés, bakeries, and similar small businesses. Please read them carefully — by creating an account or otherwise using the service, you agree to them.

1. Who we are

Stamply (the "Service", "we", "us", "our") is operated from Luxembourg. You can reach us at support@stamplycard.com for any question relating to these Terms or the Service.

2. The service in plain language

Stamply lets a business ("the Merchant") replace paper stamp cards with a digital one. The Merchant signs up, configures one or more loyalty cards, and prints a QR code. End customers scan that QR code to collect stamps and, after enough visits, redeem a reward. Customers do not need to install an app or create an account; they save the card to their phone home screen.

3. Eligibility and accounts

To create a Merchant account you must be at least 18 years old, legally able to enter into a contract, and acting on behalf of a real business that is allowed to issue loyalty rewards under the laws of its country. You are responsible for keeping your login credentials confidential and for everything that happens under your account.

4. Trial, plans, and billing

New Merchants get a free trial period as described on the signup page. After the trial, continued use of the Service requires an active paid plan. Plans are billed through Stripe in advance for the period you selected (typically monthly). By subscribing you authorise Stripe to charge your chosen payment method on each renewal until you cancel.

Prices, plan features, and trial length are shown on the public website at the time of subscription and may change for new subscriptions. We will not change the price of an active subscription without giving you notice and a chance to cancel before the change takes effect.

Cancellation and refunds

You can cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you keep access until then and are not charged again. We do not provide pro-rated refunds for partial periods, except where required by applicable consumer-protection law (notably the EU 14-day right of withdrawal for individual consumers, which does not apply once you have started actively using the Service to issue stamps).

We may suspend or terminate accounts that breach these rules. Where we do, we will tell you why and give you a reasonable chance to export your data unless we are legally prevented from doing so.

7. Customer data and privacy

Customers who scan a Merchant's QR code interact directly with Stamply. Stamply acts as a data processor on behalf of the Merchant for the limited customer information that flows through the loyalty card (e.g. the device-bound identifier used to track stamp progress and any optional data the customer chooses to provide). Detailed information on what is collected, why, and how long it is kept is in our Privacy Policy.

8. Stamply's role and limits of liability

Stamply provides the platform; the loyalty programme itself is between the Merchant and their customers. We are not party to the reward you offer and do not guarantee its delivery. We do, however, make a reasonable effort to keep the Service available, secure, and accurate.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Stamply is not liable for indirect, incidental, or consequential damages, lost profits, or lost goodwill arising out of the use of the Service. Nothing in these Terms limits liability that cannot legally be limited (for example, liability for fraud or for personal injury caused by negligence).

Where Stamply is found liable to a Merchant, our total aggregate liability for any twelve-month period is capped at the amount the Merchant paid us for the Service in that same twelve-month period.

9. Intellectual property

Stamply and its logo, design, and software are owned by us. The Merchant keeps ownership of any content they upload (logos, restaurant photos, reward descriptions, etc.) and grants Stamply a non-exclusive licence to host, transmit, and display that content for the purpose of running the Service.

10. Termination

You can close your account at any time. We can close your account if you breach these Terms, if your subscription remains unpaid, or if we are required to by law. After termination we keep limited records (e.g. invoices) for as long as legally required and delete the rest in line with the schedule in our Privacy Policy.

11. Changes to the Terms

We may update these Terms from time to time. If a change is material we will notify active Merchants by email or in the dashboard before it takes effect. Continued use of the Service after the change means you accept the updated Terms; if you do not, you can cancel.

12. Governing law and disputes

These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law rules. Disputes will be brought before the competent courts of Luxembourg City, except where mandatory consumer-protection rules give a consumer the right to bring a claim in their own country of residence.
