Terms of Service
Last updated: 26 October 2026
These Terms govern your use of Stamply, a digital loyalty card service for restaurants, cafés, bakeries, and similar small businesses. Please read them carefully — by creating an account or otherwise using the service, you agree to them.
1. Who we are
Stamply (the "Service", "we", "us", "our") is operated from Luxembourg; the operator's full details are in our Legal notice. You can reach us at support@stamplycard.com for any question relating to these Terms or the Service.
2. The service in plain language
Stamply lets a business ("the Merchant") replace paper stamp cards with a digital one. The Merchant signs up, configures one or more loyalty cards, and displays a join QR code. End customers scan that QR code to add the card to Apple Wallet or Google Wallet (or open it in their browser); staff then scan the card to add stamps and, after enough visits, the customer redeems a reward. Customers do not need to install an app or create an account. Adding a card needs an internet connection on the customer's phone.
Merchants can send lock-screen messages to their customers through the Wallet card, up to 2 per business per day, and can switch on nearby alerts that let a customer's phone suggest the card near the shop.
3. Eligibility and accounts
To create a Merchant account you must be at least 18 years old, legally able to enter into a contract, and acting for professional purposes on behalf of a real business that is allowed to issue loyalty rewards under the laws of its country. You are responsible for keeping your login credentials confidential and for everything that happens under your account.
Stamply is a business-to-business service. It is not offered to consumers, so consumer-protection rules such as the 14-day right of withdrawal do not apply to Merchant subscriptions.
4. Trial, plans, and billing
New Merchants get a free trial period as described on the signup page. After the trial, continued use of the Service requires an active paid plan. Plans are billed through Stripe in advance for the period you selected (typically monthly). By subscribing you authorise Stripe to charge your chosen payment method on each renewal until you cancel.
Prices, plan features, and trial length are shown on the public website at the time of subscription and may change for new subscriptions. We will not change the price of an active subscription without giving you notice and a chance to cancel before the change takes effect.
Cancellation and refunds
You can cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing month — you keep access until then and are not charged again. A billing month that has already started is not refunded, in full or in part. The exceptions (billing mistakes, the service being stopped by us, damaged printed products) are described in our Refund Policy, which forms part of these Terms.
Optional extras, such as printed cards beyond the monthly allowance included in your plan, are shown with their price in the dashboard before you order and are billed with your subscription.
5. What the Merchant is responsible for
- The accuracy of restaurant names, descriptions, reward terms, and any imagery uploaded to the Service.
- Honouring the rewards advertised on their loyalty card to customers who legitimately complete it.
- Compliance with local laws on promotions, food and drink offers, age restrictions on alcohol, tax treatment of free items, and consumer protection.
- Securing the device that scans QR codes and adds stamps. Stamps added on your premises by your staff are treated as authorised by you.
- Communicating to your customers, in plain language, what data you collect when they use your card (see also our Privacy Policy).
6. Acceptable use
You agree not to use the Service to:
- Offer rewards that are illegal, deceptive, or otherwise prohibited where you operate.
- Upload content that is unlawful, defamatory, infringes someone else's rights, or contains malware.
- Attempt to disrupt, reverse-engineer, scrape, overload, or gain unauthorised access to the Service or to other Merchants' or customers' data.
- Use the Service to send unsolicited marketing or to track customers in ways that would violate the GDPR or comparable privacy laws.
We may suspend or terminate accounts that breach these rules. Where we do, we will tell you why and give you a reasonable chance to export your data unless we are legally prevented from doing so.
7. Customer data and privacy
Customers who scan a Merchant's QR code interact directly with Stamply. Stamply acts as a data processor on behalf of the Merchant for the limited customer information that flows through the loyalty card (e.g. the device-bound identifier used to track stamp progress and any optional data the customer chooses to provide). Detailed information on what is collected, why, and how long it is kept is in our Privacy Policy.
Data processing terms (GDPR article 28)
For customer data on your loyalty card you are the controller and Stamply is your processor. By accepting these Terms you and Stamply agree that Stamply:
- processes customer data only to run your loyalty card as described in these Terms and the Privacy Policy, and only on your documented instructions (your settings and actions in the dashboard count as instructions);
- makes sure everyone with access to the data is bound by confidentiality;
- applies appropriate technical and organisational security measures (encryption in transit and at rest, hashed credentials, separation between Merchants);
- uses only the sub-processors listed in the Privacy Policy, imposes the same data-protection obligations on them, and tells you about new sub-processors in advance so you can object by cancelling;
- helps you answer customers' requests to exercise their rights and with security, breach notification and impact assessments, as far as reasonably possible;
- notifies you without undue delay after becoming aware of a personal-data breach affecting your customers;
- deletes or returns customer data when your account closes, within the periods in the Privacy Policy, unless the law requires us to keep it;
- makes available the information needed to show compliance with these obligations and allows reasonable audits, on request to support@stamplycard.com.
The data concerned is the random customer ID and card number, stamp and reward history, Wallet technical data and, where a customer chose to provide it, an email address or phone number, relating to your customers.
8. Stamply's role and limits of liability
Stamply provides the platform; the loyalty programme itself is between the Merchant and their customers. We are not party to the reward you offer and do not guarantee its delivery. We do, however, make a reasonable effort to keep the Service available, secure, and accurate.
Where Stamply is found liable to a Merchant, our total aggregate liability for any twelve-month period is capped at the amount the Merchant paid us for the Service in that same twelve-month period.
9. Intellectual property
Stamply and its logo, design, and software are owned by us. The Merchant keeps ownership of any content they upload (logos, restaurant photos, reward descriptions, etc.) and grants Stamply a non-exclusive licence to host, transmit, and display that content for the purpose of running the Service.
10. Termination
You can close your account at any time. We can close your account if you breach these Terms, if your subscription remains unpaid, or if we are required to by law. After termination we keep limited records (e.g. invoices) for as long as legally required and delete the rest in line with the schedule in our Privacy Policy.
11. Changes to the Terms
We may update these Terms from time to time. If a change is material we will notify active Merchants by email or in the dashboard before it takes effect. Continued use of the Service after the change means you accept the updated Terms; if you do not, you can cancel.
12. Governing law and disputes
These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law rules. Disputes will be brought before the competent courts of Luxembourg City, except where mandatory consumer-protection rules give a consumer the right to bring a claim in their own country of residence.
